  • The Booking fee ( unless stated otherwise ) is £300 and in all instances is Non-refundable in the event of cancellation by the client.
  • If you cancel inside 30 days from the wedding then Full Payment of the balance will be required.
  • If you cancel inside 120 days from the wedding then 50% Payment of the balance will be required.
  • If you cancel outside of 120 days then 25% Payment of the balance will be required.
  • Both Bride & Groom hold joint responsibility to the terms of this booking, If you are booking on behalf of your partner or third party then please ensure their consent before completion.
  • No single image, style of image, or photograph of a particular group of people is guaranteed.
  • Creative License and final decision is retained by the photographer regarding composition, colour, editing and content.
  • Copyright is retained at all times by Ian France under license to French Connection Photography Ltd. Even if you purchase the Digital Files you may only print and share the images for your own enjoyment. The files may not be altered or used / sold commercially.
  • If the photographer is unable to attend due to illness or factors outside of the photographers control, the photographer will make all reasonable efforts to supply an alternative.
  • Credit Card Payments incur a surcharge of 3% ( Debit Cards and other payments are accepted free of charge ).
  • Whatever happens all Liability is Limited to a Full Refund

IMPORTANT TERMS OF BOOKING IN DETAIL – PLEASE READ

The Booking & Payment

An executed copy of this Agreement and a Booking Fee is payable to secure The Photographers services for The Clients date. The Booking Fee will be deducted from your total balance. The remaining balance will then be payable 30 days before the wedding. In the event that The Client fails to pay the remaining balance within seven (7) days of the wedding date, The Photographer may, at their discretion, treat this agreement as if terminated by The Client. Upon payment of the Booking Fee, The Photographer will reserve the event date on behalf of The Client(s) and reject all other requests for event coverage on that date. Thus, if for any reason the wedding is cancelled or postponed, all monies paid are non-refundable, non-transferable and the booking will be subjected to the following cancellation policy. Cancellation Policy – All Cancellations must be made in writing, the date of receipt of the cancellation notice shall determine the cancellation penalty that shall apply. Percentage of outstanding balance payable in the event of cancellation ( days from the wedding date ) – 0-30 days = 100%, 31-120 days = 50%, 121 days and over = 25% Prices – All prices are subject to variation at any time at the sole discretion of The Photographer, variations may be in context to any additional operating expenses or charges incurred prior to or during the event. The Client shall be notified in writing of any such variation and shall reserve the right to cancel without penalty.

Liability & Force Majeure

The Photographer’s entire liability to The Client for any claim arising from any part of this contract is limited to a full refund to The Client of the amount paid for services and products. Examples of this are listed below but not limited to. Performance – Although every effort is made to complete professional obligations, The Photographer’s performance or agents and servants (including other photographers, processing laboratories and postal and delivery agents), are not guaranteed. Breakdown – In the unlikely event of equipment failure or breakdown in available transport then the limit of liability for a partial loss of originals shall be calculated pro-rata to the amount of the photographs lost based on the percentage of total number of originals. Illness or Injury – In the unlikely event of personal illness, Acts of God, or other circumstances beyond the control of The Photographer, a substitute photographer may be sent to fulfil the obligations of The Photographer herein contracted. If a substitute photographer is provided, The Client has the right to refuse to accept the substitute photographer and may instead terminate this agreement and receive a full refund of all monies paid with the exception of the Booking Fee.

Creative License

Artistic Judgement – The Photographer shall be granted creative and artistic license in relation to the choice of locations and poses used. Judgement on photographic style and the number of photographs taken and delivered shall be deemed correct and the photographers decision final. On its own behalf, and on behalf of the subject, The Client acknowledges that they are familiar with The Photographer’s portfolio and are requesting services with knowledge of The Photographer’s style.The client also accepts that The Photographer’s work is constantly evolving and changing to meet modern standards and artistic merit, and that The Photographer’s services are of unique and artistic nature. The photos supplied may be different from photographs taken by The Photographer in the past; and that in creating the photos, The Photographer shall use his personal artistic judgment to create images consistent with his personal vision of the event, this vision may be different from The Client’s and the subject’s vision of the event. Accordingly, The Client acknowledges that the photographs shall not be subject to rejection on the basis of taste or aesthetic criteria. Content – The photographer will endeavour to take all the photographs agreed or requested within reason. However, because a wedding is not controlled by the photographer, then the photographer cannot guarantee delivery of any specifically requested image(s), and cannot guarantee to incorporate any specific background, location or group arrangement, especially if timings or circumstances such as changes of the weather, and the availability and willingness of subjects prevents such request being delivered. The Photographer will automatically re-take any photograph where they have seen that someone has blinked, but it is impossible to guarantee to see them all. The more people in the photograph the more difficult it is to see everyone. Eyes open in all images is not guaranteed. House Rules – The guidelines of the ceremony official and the reception site management may limit The Photographer. The Client agrees to accept the technical results of their imposition on The Photographer. Negotiation with the officials for moderation of guidelines is The Client’s responsibility; The Photographer will offer technical recommendations only when requested. Colour & Digital Imaging – The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials, especially man made fibres, it is sometimes impossible to record on film/digital media the exact colour of materials as seen by the human eye. Retouching – Retouching and artistic embellishment is inclusive at the discretion of the photographer within reason, the photographer’s decision in respect of “reasonable” is final. Any requested or additional editing and/or retouching will be subject to an hourly rate of £40 per hour. Retouching includes but is not limited to additional skin softening/smoothing, correction of hair/makeup/clothing, swapping a face from one image to another, environmental effects, reflections in glasses, teeth whitening, brightening of eyes, and bodily enhancements.

Exclusivity

The Photographer shall be the sole (stills) photographer(s) attending the event for hire or reward. Other professional photographers shall only attend with the express permission of the photographer. Other services such as non-journalistic videography may significantly interrupt the photographers ability to deliver expected results. The clients shall consider all timings applicable and allow adequate production time for all services.

Delivery

Once an album or set of high resolution digital files have been delivered to the client, the responsibility to preserve the images passes to The Client, and the decision whether The Photographer will keep a copy or not will be entirely at The Photographer’s discretion.

Copyright 

The 1988 Copyright Act assigns the copyright to the photographer. It is contrary to the Act and strictly illegal to copy or allow to be copied, any photographs covered by this contract. If the client purchases digital files then The Photographer grants The Client unlimited print licence. The Photographer grants The Client permission to also make digital copies of the images under the conditions that the images taken by the Photographer are for personal use by The Client and their friends and relatives,The images may not be offered for Sale, Publication or any Commercial use without prior written permission from The Photographer. The Photographer shall not be liable for Breach of copyright by The Client, The Client agrees to cover all risks, legal costs and liability in the event of images being used by third parties as a result of The Clients negligence. The photographer does not accept liability for any damages claim that arises as a result of client’s use whether authorised by this agreement or not.

Model Release

The Client hereby grants The Photographer the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included for editorial, trade, advertising or any other purpose and in any manner and/or medium considered standard by the wedding industry. Such mediums/purposes include, but are not limited to: advertising, internet promotion, photographic contests, public displays, photography books, wedding blogs, studio display, sample wedding albums, and any other use thought proper by The Photographer and considered standard by the wedding industry. If The Client is aware of anyone attending the event that does not wish to be photographed or published then The Client shall notify The Photographer in due course.

Albums & Products

Approvals – Album designs, changes and approvals shall be completed in reasonable time. If The Client fails to offer image selections, album approvals or amendments from 6 months of design completion, then The Photographer reserves the right to order and deliver the album at The Photographers discretion. Any increase in costs incurred by The Photographer, such as wholesale album price increases, shall be covered by The Client. Availability – The Photographer reserves the right to withdraw any service or product at any time without incurring additional liability, should this situation arise then The photographer will make all efforts to supply alternative products or services of similar quality. Size – All dimensions and sizes quoted are considered approximate.

Amendments

This contract has been freely negotiated and shall be recognised as the entirety of the agreement. Only those changes or modifications specifically placed in writing, attached, dated and signed by The Client and The Photographer at the time of acceptance of this contract shall be recognised as amendments to this contract. In the event of any dispute regarding this contract, both parties agree to consult mediation to try and obtain a conciliation before taking any other action. By completing this document you are entering into a legally binding contract and you are urged to read and understand the terms and conditions carefully.
